Welcome to the Nasser Al Salem for Photography Services store (hereinafter referred to as the "Store", "we" or "us"). The Store is registered and operated within the Kingdom of Saudi Arabia and provides photography, videography, and design services of all kinds (hereinafter the "Services").
These Terms and Conditions apply to all Services provided through the Store. By completing a booking or paying the first installment or the full amount, the Client expressly agrees to these Terms and Conditions. Please review them carefully before confirming your order. If you do not agree with any provision, please do not complete the order.
Store: the website nassercapture.sa and its associated applications and platforms.
Client: any natural or legal person who orders or purchases Services through the Store.
Services: all photography, videography, design, and related services listed in the services menu, or any additional service requested by the Client.
Agreement: the service contract concluded between the Store and the Client, comprising these Terms and Conditions, the order form, and invoices.
Execution Date: the date and time of the photography session or commencement of the Service as agreed between the parties.
Placing orders: the Client submits the order through the online store, providing all required information accurately (service type, date, location, technical details).
Order confirmation: an order is deemed confirmed and effective once the Store accepts it in writing (by email or approved communication channels) and receives the first installment or the full amount as specified in the offer.
Order modification: the Client may modify the order details free of charge within twenty-four (24) hours of confirmation, without prejudice to the rescheduling provisions in Section 3.
Real estate photography orders: additional information must be provided (property area, number of rooms, type of photography required, and any site-specific restrictions).
Prices: prices are displayed in Saudi Riyals (SAR) and include VAT where applicable. The Store may amend prices at any time; however, the prices agreed at the time of order confirmation shall be binding on both parties.
Coverage area: prices cover services performed within the city of Riyadh. Locations outside Riyadh are subject to travel fees determined by distance and agreed upon before order confirmation.
Payment methods: payment is made via the electronic payment methods available in the Store, bank transfer, or any other method agreed by the parties.
First: Statutory cancellation right (per the Saudi E-Commerce Law):
The Client may cancel the order and receive a full refund within seven (7) days of order confirmation, provided the Service has not been performed or commenced.
If the Client chooses to schedule the Execution Date within the aforementioned seven (7) day period, their approval of the date constitutes express consent to commence performance of the Service. The free cancellation right lapses once the Service is performed, and the cancellation provisions below shall then apply.
Second: Cancellation by the Client (after the statutory period):
Cancellation more than fourteen (14) days before the Execution Date: the Client receives a full refund of all amounts paid.
Cancellation between seven (7) and fourteen (14) days before the Execution Date: the Store may retain fifty percent (50%) of the first installment (deposit), and any amounts paid in excess shall be refunded to the Client.
Cancellation less than seven (7) days before the Execution Date: the Store may retain the full first installment (deposit), and any amounts paid in excess shall be refunded to the Client.
Third: Cancellation by the Store:
The Store may cancel a booking in cases of force majeure, such as weather conditions unsafe for photography, denial or revocation of an aerial photography permit by the competent authorities, or emergencies preventing the photographer from attending. In such cases, all amounts paid shall be refunded to the Client, or the appointment rescheduled at the Client’s preference, free of charge.
Fourth: Rescheduling:
The Client may request to reschedule the session at least seven (7) days before the scheduled date at no additional cost, subject to the photographer’s availability on the alternative date.
Rescheduling less than seven (7) days before the date: the Client is entitled to one free reschedule; any subsequent reschedules are subject to a fee of SAR 200, or shall be treated as a cancellation under the provisions above if rescheduling is not feasible.
Fifth: Session overtime:
If the Client requests unagreed changes or additions that extend the session time by more than twenty-five percent (25%), an additional fee of SAR 300 shall apply for each additional hour or part thereof.
The delivery period specified in each service or package description commences from the end of the photography session.
Rush delivery: where requested, deliverables are provided within forty-eight (48) hours of the session for an additional fee of forty percent (40%) of the package value.
The Client is entitled to two free revision rounds on the final deliverables (color adjustments, cropping, and exclusions). Additional rounds are subject to fees agreed in advance. Free revisions do not include reshoots or changes to the scope of work.
File retention: the Store retains final files for sixty (60) days from the delivery date, after which they are deleted without liability on the Store. The Client is responsible for saving their own copies upon receipt.
The Store retains all intellectual property rights in the RAW files and resulting artistic works.
Upon full payment, the Store grants the Client a non-exclusive, non-transferable license to use the final (edited) images for personal purposes or for marketing the photographed property or business.
Extended commercial use (paid advertising campaigns, print materials, outdoor billboards, resale, or sub-licensing to third parties) requires a separate written agreement.
The Client is prohibited from: selling, distributing, or altering the images without prior written permission; using them in any unlawful, offensive, or defamatory context; or removing any watermark or trademark belonging to the Store.
Portfolio use: the Store may use images of properties and commercial projects in its portfolio and marketing platforms unless the Client requests otherwise in writing. Images in which individuals are identifiable (personal sessions and events) shall only be published with the Client’s prior written consent.
The Store processes personal data in accordance with the Personal Data Protection Law (PDPL) of the Kingdom of Saudi Arabia and its implementing regulations.
Purposes of collection: Client data (name, contact details, location and order details) is collected solely for service delivery, communication, invoicing, and improving the experience.
The Store does not sell, rent, or disclose personal data to any third party except as required by law or as necessary to perform the Service (e.g., payment gateway providers).
Client rights: the Client may request access to, correction of, or deletion of their personal data by contacting the email address listed in the Contact section.
Retention: data is retained for the period necessary to fulfill the purposes of its collection or as required by law, and is then securely destroyed.
The Store exerts its best efforts to provide high-quality services and deliver them on the agreed schedule.
The Store is not liable for any delay or non-performance resulting from circumstances beyond its reasonable control.
The Store does not guarantee commercial outcomes (such as the sale or rental of a property) through the images provided, as results depend on multiple external factors.
The Store’s maximum financial liability for any error or default shall not exceed the amount paid for the Service in question.
The Client bears full responsibility for any damage to photography equipment resulting from negligence or deliberate acts by the Client or any person under their responsibility during the session.
The Client is responsible for: the safety and ownership of the contents of the property; any damage to third-party property during the shoot; and ensuring there are no legal or regulatory impediments to photography at the location (neighbors’ privacy, restricted areas, etc.).
The Client undertakes to provide a safe environment for the photographer and their equipment during the session, and to hand over the location clean and photo-ready at the scheduled time. Any delay caused by the location not being ready shall be counted against the session time.
Aerial Photography (Drone):
Aerial photography is subject to applicable Saudi regulations and is performed by the Store through a licensed pilot.
The Store obtains the required aerial photography permits from the competent authorities. The Client is responsible for obtaining the property owner’s consent and disclosing in advance any known restrictions at the location.
If a permit is denied or revoked by the competent authorities, the aerial photography service fee shall be refunded to the Client or the service rescheduled, without any further liability on the Store.
No waiver: the Store’s failure to enforce any right under these Terms shall not constitute a waiver of that right.
Force majeure: the Store shall not be liable for any failure to perform its obligations due to any cause beyond its reasonable control.
Severability: if any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Amendments: the Store reserves the right to amend these Terms and Conditions at any time. Amendments take effect for new orders upon publication on the website; orders confirmed before an amendment remain subject to the version in force at the time of confirmation.
In the event of any dispute, the parties undertake to first seek an amicable resolution through direct negotiation.
If an amicable resolution cannot be reached, the courts of the city of Riyadh, Kingdom of Saudi Arabia, shall have jurisdiction over any dispute arising from this Agreement, and the laws in force in the Kingdom shall apply.
